Terms of Service

1. Agreement And Provider

These Terms govern your use of the Vivamus AI website, iOS app, and related services (“Vivamus” or the “Service”). The Service is provided by Igor Velykokhatko, operating as Vivamus AI in Poland (“we,” “us”). These Terms are between you and us, not Apple.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use Vivamus. Contact us at founders@vivamus.ai.

2. The Service

Vivamus is an AI conversation partner for reflection, self-understanding, goals, choices, and personal growth. It offers text and voice conversations and may use relevant conversation history, structured memories, and profile information you confirm to personalize the experience.

Vivamus does not autonomously take actions in the world for you. If you explicitly choose to add approved commitments to Apple Reminders and grant Reminders permission, Vivamus can write those commitments to the Reminders app; it does not do so without that choice and permission. Features may evolve, but any paid plan is governed by the benefits, price, billing period, and limits shown before purchase.

3. Not A Therapist, Adviser, Rescuer, Or Emergency Service

Vivamus is not a therapist, doctor, mental-health provider, professional adviser, coach, rescuer, crisis line, or emergency service. It does not provide diagnosis, treatment, medical, legal, financial, or other professional advice. No person monitors your conversations in real time, and automated safety messages may be incomplete or wrong.

Do not rely on Vivamus to detect distress, contact another person, rescue you, or make a safety-critical decision. If you may harm yourself or someone else, or face an emergency, stop using Vivamus and contact local emergency services or qualified human support immediately.

4. Eligibility And Accounts

You must be at least 18 years old and legally able to agree to these Terms. You are responsible for activity under your account and for keeping access to your Apple account and device secure. Provide accurate information and notify us promptly of suspected unauthorized use.

5. AI Processing And Outputs

You are interacting with an AI system. Its responses, transcripts, summaries, memories, and other outputs are machine-generated, not written or reviewed by a person in real time.

AI responses may be inaccurate, incomplete, inconsistent, offensive, or unsuitable for your circumstances. They are generated from patterns in data, not human judgment or knowledge of your full situation. Vivamus does not guarantee a result, transformation, insight, decision, relationship outcome, health outcome, or any other outcome.

You are responsible for evaluating outputs and deciding whether to act. Do not use Vivamus for medical, mental-health, legal, financial, employment, eligibility, emergency, or other high-impact decisions.

AI conversation features require permission to send the content and context described in our Privacy Policy to OpenAI. You may turn off new OpenAI processing in app settings, but AI conversation features will then be unavailable.

6. Apple Subscriptions

These service terms govern the Vivamus service. Apple’s applicable Media Services and app-license terms also govern your acquisition and use of the iOS app. We, not Apple, are responsible for operating, maintaining, supporting, and addressing claims about the Vivamus service, except where law or Apple’s terms provide otherwise.

Vivamus AI offers auto-renewable monthly and annual subscriptions through Apple’s App Store. Before you confirm, the app and Apple show the localized price, billing period, included features, eligibility for any introductory trial or offer, and applicable plan limits; those details form part of your purchase terms. If you start an eligible free trial, your subscription begins immediately and Apple charges the displayed renewal price after the trial unless you cancel before it ends. Otherwise, Apple charges your Apple Account when you confirm. The subscription then renews automatically at the displayed renewal price unless you cancel.

Your subscription renews automatically until you cancel it through Apple. Manage or cancel it in App Store settings or at Apple Subscriptions. Deleting your Vivamus account or app does not cancel billing; cancel with Apple before deleting your account if you do not want renewal.

Apple administers the App Store transaction and refund workflow. You may request an eligible refund through Apple’s Report a Problem. Apple’s process does not reduce mandatory consumer rights you may have against us. Nothing in these Terms limits applicable rights relating to withdrawal, non-conforming digital services, refunds, or other remedies.

7. Voice And Usage Limits

Your plan may include a monthly voice allowance, a maximum voice-session duration, technical rate limits, and fair-use controls. The limits presented for your plan or in the app govern the relevant period. When a limit is reached, voice may pause until the allowance resets or your access changes; available text and account-control features may remain usable.

Limits protect service reliability, cost, and safety. We may change limits for future periods with reasonable notice where required, or sooner when necessary to address abuse, security, law, or a material provider constraint.

8. Your Content

You retain the rights you have in content you submit. You give us a non-exclusive license to host, process, transmit, transform, summarize, display, and secure that content only as needed to provide, personalize, protect, and troubleshoot the Service, handle support, and comply with law. This license ends when the content is deleted, subject to lawful retention and backup processing described in the Privacy Policy.

Only submit content you have the right to use. Avoid including another person’s personal data without a lawful reason. As between you and us, and subject to applicable law and third-party rights, you may use outputs generated for you. Outputs may not be unique, and another user may receive similar content.

9. Acceptable Use

You may not use Vivamus to violate law or another person’s rights; exploit or endanger a person; create abusive, deceptive, or unlawful material; distribute malware; interfere with the Service; probe or bypass access, safety, subscription, or usage controls; scrape or reverse engineer protected systems except where law permits; or use automated access without our written permission.

10. Privacy

Our Privacy Policy explains the personal data used for conversations, profile and memory, voice, analytics, subscriptions, security, account deletion, backups, and rights requests. It forms part of the information provided with these Terms.

11. Intellectual Property

The Service, including its software, brand, design, interfaces, and related materials, is owned by us or our licensors. We give you a personal, limited, revocable, non-exclusive, non-transferable license to use the app and Service under these Terms. These Terms do not transfer our intellectual property to you.

12. Availability And Changes

We work to keep Vivamus available but do not promise uninterrupted or error-free operation. We may maintain, secure, repair, or change the Service and may discontinue a feature. Where a change materially affects a paid service, we will provide notice and any remedy required by applicable law.

13. Suspension, Termination, And Account Deletion

We may suspend or terminate access when reasonably necessary because you materially breach these Terms, create a security or legal risk, misuse the Service, or fail to pay through Apple. Where practical and legally permitted, we will provide notice and an opportunity to address the issue.

You may stop using Vivamus and delete your account in app settings at any time. Account deletion is permanent and handled as described in the Privacy Policy. It does not cancel an Apple subscription; subscription cancellation is a separate step with Apple.

14. Disclaimers

To the extent permitted by law, Vivamus is provided “as is” and “as available.” We do not guarantee that the Service or any output will be accurate, complete, available, secure, suitable for a particular purpose, or free from third-party claims. These disclaimers do not affect warranties or remedies that cannot lawfully be excluded for consumers.

15. Liability

To the maximum extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when you agreed to these Terms, losses caused by your misuse or reliance contrary to these Terms, or business losses arising from consumer use. These Terms do not exclude or limit any liability or consumer right that applicable law does not allow us to exclude or limit.

16. Governing Law And Disputes

Polish law governs these Terms. If you are a consumer, this choice does not deprive you of mandatory protections or courts available under the law where you habitually live. Before starting a dispute, contact founders@vivamus.ai so we can try to resolve it. We do not require private arbitration.

17. Changes To These Terms

We may update these Terms for future use when the Service or law changes. We will change the “Last Updated” date and give additional notice when required. Material changes apply prospectively unless law requires otherwise. If you do not accept an update, you may stop using the Service and cancel your subscription.
