U.S. Consumer Health Data Privacy Notice

1. Scope

This notice supplements our Privacy Policy for residents of Washington and other U.S. jurisdictions with consumer health data laws. Vivamus is a general-wellness conversation service, not a health-care provider, and is not a substitute for medical or mental-health care. Contact founders@vivamus.ai with questions or requests.

2. Consumer Health Data We May Collect

Depending on what you choose to discuss, Vivamus may collect or infer information reasonably linked to you about mental or physical health, emotions, habits, sleep, exercise, relationships, sexuality, reproductive or gender-related matters, social or psychological interventions, and other well-being topics. This can appear in conversation text, voice transcripts, AI replies, structured memories, observations, values, goals, profile information, and safety metadata. We process audio during voice interactions but do not keep raw voice audio as an account recording after the processing request ends.

We do not request precise location for these purposes. We use a country code derived from device locale only to select region-appropriate safety resources.

3. Sources And Purposes

We obtain this data directly from the content and profile information you provide, from your use of requested app features, and from inferences or outputs created by OpenAI and Vivamus while providing those features. We do not buy it from data brokers.

We collect and use consumer health data only as necessary to provide the conversation, continuity, personalization, memory, profile, voice, and safety-resource features you request; respond to your support or rights request; secure the service; or comply with law. We do not use it for advertising, build advertising profiles from it, sell it, or use geofencing around health-care facilities.

4. Processors And Sharing

OpenAI. We send the conversation text or audio you choose to submit and relevant transcripts, history, profile, and memory context so OpenAI can generate replies, transcribe speech, speak responses, and help derive continuity and personalization information.

Google Cloud and Neon. These providers supply hosting and storage needed to operate Vivamus. Operational logs are designed not to include private conversation content.

Amplitude and Google/Firebase. When analytics is enabled, these providers may receive limited pseudonymous product-usage data, but not consumer health or conversation content. Firebase Crashlytics separately receives crash and reliability diagnostics without conversation or profile content.

We have no affiliates that receive consumer health data. Apple may process account, device-service, and subscription data under its own relationship with you, but we do not send Apple your private conversation content for advertising.

We do not share consumer health data with unaffiliated third parties as that term is defined by Washington law, except at your direction, as necessary to provide a service you request, or where law permits or requires. We do not sell consumer health data.

5. Your Rights

You may ask us to confirm whether we collect, share, or sell consumer health data about you; access that data and a list of recipients; withdraw consent for future collection or sharing; or delete the data. You can also delete your account in the app. Email founders@vivamus.ai to make a request or appeal a refusal. You do not need to create a new account, and we will not discriminate against you for exercising a right.

We may take reasonable steps to authenticate your request. We will respond within the time required by applicable law and will notify processors or other recipients of a verified deletion request where required. For a verified Washington request, deletion from archived or backup systems may be delayed only as permitted by law and no longer than six months.

6. Changes

We will not collect, use, or share additional categories of consumer health data, or use disclosed data for materially different purposes, without first updating this notice and obtaining affirmative consent where applicable law requires it.
